A drug patent is a patent issued by the patent and trademark often on the drug or some aspect of it.


What is the difference between a drug patent and FDA drug exclusivity?
Patents and exclusivity apply to drugs in different ways. Patents can be issued or expire at any time regardless of the drug's approval status and are issued by the patent and trademark office. Exclusivity attaches upon approval of a drug product if the statutory requirements are met and is granted by the FDA. How long is a drug patent?
Patents are typically 20 years from the date of filing. Based on the filing date and the drug approval date the patent life left after drug approval is much shorter than the 20 years.
